Are Sweepstakes Casinos Legal in Montana?
Short answer: no. Montana was the first state in the country to enact a dedicated sweepstakes casino ban, and it has been in effect since October 1, 2025.
The law: SB 555 (Chapter 626, Laws of 2025)
Senate Bill 555 doesn't use the word "sweepstakes" - instead, it works by rewriting Montana's statutory definition of "internet gambling" (MCA §23-5-112) to cover any online casino, "by whatever name known," that lets users wager in any form of currency and pays out winnings in any form of currency. That broad redefinition is specifically what sweeps in the dual-currency Gold Coin / Sweeps Coin structure our guide to how the model works describes. Signed by Governor Greg Gianforte in May 2025, the law took effect October 1, 2025.
Penalties
Violations fall under MCA §23-5-162 as a felony, carrying up to a $50,000 fine and/or up to 10 years in prison, per violation - among the harshest penalty structures of any state on this list - plus mandatory revocation of any state licenses or permits the operator holds.
What this means for you
If you're a Montana resident, expect every legitimate sweepstakes casino to block your access outright - the ban has been in force for over a year as of this writing, and the felony-level penalties give operators essentially no reason to test it. A site that still lets Montana players through is a red flag, not a loophole.
