Are Sweepstakes Casinos Legal in Pennsylvania?
Short answer: still legal for now. A bill that would ban sweepstakes casinos outright - House Bill 2801 - was filed in October 2026, but it was introduced late in the legislative session and has a real risk of dying before it gets a vote.
What HB 2801 would do
Filed by Rep. Russ Diamond along with several co-sponsors, HB 2801 would make it unlawful to operate, conduct, or promote an "online sweepstakes game" in Pennsylvania, as well as to support or assist one - language written to capture the Gold Coin / Sweeps Coin dual-currency structure (see our guide to how the model works). The Pennsylvania Gaming Control Board and the state attorney general would gain the power to investigate, issue subpoenas, and send cease-and-desist orders, with violations carrying fines of $50,000 to $500,000 per infraction. The bill isn't narrowly focused, either - it's bundled with unrelated gaming-tax changes, including a single 49.9% tax rate for licensed online slots, table games, and poker, a sports wagering tax hike from 34% to 36%, and expanded video terminal licenses for liquor-licensed restaurants and clubs, capped at five terminals per location.
A tight timeline
As of this writing, HB 2801 has only been referred to the House Gaming Oversight Committee, with no hearing date set. Pennsylvania's 2025-26 legislative session ends November 30, 2026, with only a handful of scheduled session days left - and bills don't carry over into the next session, so this one either moves quickly or has to be reintroduced from scratch in 2027.
What this means for you
Sweepstakes casinos remain fully available to Pennsylvania residents today - nothing in HB 2801 is in effect, and it may not pass at all given how little time is left in the session. Still, a bill with real financial penalties and regulator subpoena power attached is worth watching, especially since Pennsylvania already runs one of the country's largest regulated real-money online gambling markets and has an obvious incentive to push unlicensed-feeling competition out.
